  • To enter the Contest go to Sleepytimelullaby.com and follow the entry instructions. The Sing Your Way to Sleepytime® Contest entry period begins at 12:01 AM Eastern Time ("ET") on October 1, 2012 and ends at 11:59 PM ET on October 30, 2012. Video must be no longer than 3 minutes, and should contain a video of no more than five individuals, with any or all singing one of the pre-approved lullabies.
  • No purchase or payment is required to enter or win. The Sing Your Way to Sleepytime® Contest (the "Contest") entry period begins at 12:01 AM Eastern Time ("ET") on October 1, 2012 and ends at 11:59 PM ET on October 30, 2012 (the "Entry Period"), when all entries must be received. Eastern Time shall control for all purposes of this Contest. Celestial Seasonings, Inc. ("Sponsor") shall be the official timekeeper for the Contest. The Contest is governed by these Official Rules and is subject to all applicable U.S. federal, state and local laws. Void where prohibited or restricted by law or regulations.

    1. Eligibility. The Contest is open only to legal residents of the United States (excluding Arizona, and US territories, possessions), who are 18 years of age or older at the time of entry ("Entrants"). Proof of residency and age may be required. Employees of Sponsor, Facebook Inc., and their respective subsidiaries, divisions, affiliates, advertising or promotional agencies, and the immediate family and household members of such individuals, are not eligible to enter or win. Facebook employees are ineligible because Sponsor will utilize Facebook to promote the Contest. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. In order to enter the Contest or receive a prize, Entrants must fully comply with the Official Rules and, by entering, Entrants represent and warrant that they agree to be bound by these Official Rules and the decisions of the Sponsor-designated judges, whose decisions shall be binding and final in all respects relating to this Contest.
    2. How to enter. To enter the Contest, during the Entry Period, go to Sleepytimelullaby.com (the "Sponsor's Contest Website") and follow the entry instructions, which will require, among other things, that Entrant complete an official entry form and upload his/her video entry showing the theme of the Contest, namely sharing lullaby moments with loved ones ("Theme"). Video must be no longer than 3 minutes, and should contain a video of no more than five individuals, with any or all singing one of the pre-approved lullabies. Entrant may create his/her own version of lyrics to the pre-approved lullabies.

      The following public domain melodies for lullabies have been approved for use in the videos (see hyperlinks for audio samples): "Beautiful Dreamer," "Hush Little Baby," "Twinkle, Twinkle Little Star," "Rock-a-Bye Baby," "Brahms' Lullaby (Cradle Song)" and "Are You Sleeping (Frere Jacques)." Any video that contains any other melody will be disqualified automatically.
    3. Entry Requirements.

      (a) All entries must be created solely by the Entrant; must not have been previously published, released or distributed in any form, including postings on the World Wide Web; must not have been entered in or won previous contests or any award; must not in any way violate applicable laws and regulations; and must not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity. Entries may contain a Celestial Seasonings® brand name, product or logo but must not contain or reference any names, products or services of any other company or entity or other third party trademarks, logos, trade dress or promotion of any brand, product or service.

      (b) Entries should not contain any background photographs or artwork that may be subject to copyright protection.

      (c) Entries that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or entries that otherwise contain inappropriate content or objectionable material should not be submitted and may be disqualified at any time in Sponsor's sole and unfettered discretion.

      (d) For Entrants' protection, entries should not contain any personally identifiable information. Should Entrant include personally identifiable information in an entry, Entrant acknowledges and agrees that such information will be disclosed publicly and Entrant is solely responsible for any consequences thereof.

      (e) Sponsor reserves the right in its sole and unfettered discretion to disqualify any entry that it believes violates or potentially violates any of the foregoing requirements or otherwise fails to comply with any provision of these Official Rules. The decisions of Sponsor on this and all matters pertaining to the Contest shall be final and binding.

      (f) Limit one (1) entry per person throughout the Entry Period. Entries by the same person in excess of the limits stated herein will be disqualified. Sponsor will deem all entries to have been submitted by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. All submissions become the property of Sponsor upon receipt and will not be acknowledged or returned.

      (g) By submitting an entry, Entrant agrees to the Grant of Rights set forth below, to have his/her entry posted on the Internet and understands that his/her image as well as the image of any other person contained in the entry will be viewable on the Internet. Entrant warrants and represents that he/she has obtained permission from all individuals featured in the video to participate in this Contest and to appear on the Internet during the Contest. In addition, Entrant warrants and represents that he/she has obtained permission from the parent or legal guardian of any child featured in the video to participate in this Contest and to appear on the Internet during the Contest, if Entrant is not the parent or legal guardian. Sponsor reserves the right to request proof of such permission in a form acceptable to Sponsor from any Entrant at any time. Failure to provide such proof may render entity null and void.
    4. Selection of Winners: Finalists: Entries will be posted to Sponsor's Contest Website for public viewing and judging beginning at 12:01 AM ET on October 31, 2012 and ending at 11:59 PM on November 14, 2012. The public will vote for entries on the Sponsor's Contest Website based on each entry's appropriateness to the Theme. Limit one (1) vote per person per day. A day is defined as each consecutive twenty-four (24) hour period starting at 12:01 AM ET and ending at 11:59 PM ET. Use of script, macro or any device to automate voting is prohibited, as are use of "vote farms" or other similar services to purchase or otherwise commercially acquire votes, and any entries or votes received through such means (or other means deemed to be unsportsmanlike, improper or otherwise inappropriate by Sponsor in its discretion) will be void. Any attempt by any voter to submit more than the stated number of votes by using multiple/different email addresses, identities or any other method will void that person's votes and entry (if any), and he/she may be disqualified from further voting or other participation in the Contest. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected votes. Multiple votes received from any person or email address after the first vote received from that person or email address in a day will be void. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by the Sponsor in its sole discretion. In the event of a dispute as to any vote, the authorized account holder of the email address used to vote will be deemed to be the voter. The authorized account holder is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

      Sponsor's designated judges will also rank entries on a scale of 1 to 10 based on (i) creativity, (ii) appropriateness to the Theme and (iii) the public vote. Judges will weigh each of the three criteria equally in choosing finalists. The 10 entries that receive the highest rankings from the Sponsor's designated judges will be deemed finalists. In the event of a tie, judges will choose a finalist based upon assigning new ranks for appropriateness to the Theme. Finalists will be announced on or about November 15, 2012. b) Grand Prize and Finalist Prizes: On or about November 21, 2012, Sponsor-designated judges will review all ten Finalists' entries. They will choose a Grand Prize Winner in their sole discretion, based on (i) creativity and (ii) appropriateness to the Theme. In the event of a tie, judges will choose a finalist based upon assigning new ranks for appropriateness to the Theme.

      Odds of winning depend on the nature, quality and number of eligible entries received. Decisions of judges are final and cannot be appealed. In the event of a tie, the Entrant involved in the tie with the highest combined creativity score will be selected as the winner.
    5. Prizes. All prizes will be awarded in the name of Entrant.

      a) Grand Prize (1): a "Bedroom Makeover" in the form of one $5,000 gift card to Pottery Barn plus a year's supply of Sleepytime® Tea (24 boxes of tea). (Total ARV: $5,072).

      b) Finalist Prizes (9): one (1) $400 Pottery Barn gift card for each Finalist not named Grand Prize Winner, plus a year's supply of Sleepytime® Tea (24 boxes of tea each) (Total ARV: $472).

      No transfer, refund, cash redemption, substitution, cash equivalent or replacement of prize permitted by winner, except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value (or cash equivalent). In the event the ARV of a prize is different from the actual retail value of that prize, the difference will not be awarded in cash. Applicable federal, state and local taxes are the sole responsibility of winner. Any portion of the prize not accepted or unclaimed and/or unused by the winner will be forfeited and will not be substituted. In no event will more than the stated number of prizes be awarded. Sponsor not responsible for prizes of third-party providers. Gift cards may include deadlines for use, expirations, and exclusions.
    6. Winner Notification. On or about November 21, 2012, selected potential winners will be notified by mail, phone and/or e-mail, at Sponsor's discretion, using the information provided on the potential winner's entry form. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by potential winner for any reason. In Sponsor's sole discretion, selected potential winner may be disqualified and required to forfeit the prize, and an alternate potential winner may be selected in accordance with these Official Rules from among the remaining eligible Entrants if selected potential winner: (i) cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the potential winner's entry form or winner notification is returned as undeliverable; (ii) declines or cannot accept, receive or use the prize for any reason; (iii) is found to be ineligible to enter the Contest or receive the prize; or (iv) cannot or does not comply with these Official Rules. Forfeited prizes may not be awarded. Sponsor is not obligated to leave voice mail, answering machine, or other messages for any potential winner. Selected prize winners will be required to complete, notarize and return (as directed by Sponsor) an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law) (collectively, the "Affidavit") within 14 days of date specified in notification or, in Sponsor's sole discretion, prize may be forfeited and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible Entrants. Sponsor reserves the right to modify the notification and Affidavit procedures in connection with the selection of alternate winner, if any.
    7. Publicity Release; Use of Personal Information Except where prohibited by law, by accepting a prize, winners agree and acknowledge that Sponsor and any of its designees may, without any limitation or further compensation, use winners' and other person's in the videos full names, city and states of residence, photographs or other likenesses, entries, pictures, portraits, voices, testimonials, biographical information (in whole or in part), and/or statements made by winners regarding the Contest or Sponsor, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval ("Publicity Release"). If any person shown in a potential winner's video refuses to provide a Publicity Release either for him/herself or for any minor in the video entry for whom he/she is the parent or guardian, the potential winner will be disqualified and another winner may be selected. By participating in the Contest, Entrants and anyone shown in the video submissions will be sharing their personal information with Sponsor. Personal information collected by Sponsor will be used solely for administration of the Contest and awarding the prize.
    8. Grant of Rights All Entrants irrevocably grant Sponsor, its subsidiaries, divisions, affiliates, and advertising and promotional agencies, an unlimited, worldwide, perpetual, non-exclusive, royalty-free, unconditional license and absolute right to edit, modify, adapt, distribute, stream, post, publish, broadcast, reproduce, store, copy, transmit, publicly display, exhibit, exploit, whether for profit or not, and/or otherwise use the entry (in whole or in part) and copyrights therein, in any way and in any and all media, in Sponsor's sole discretion, including but not limited to, the posting on social networking sites or any websites owned or operated by Sponsor or its affiliates, divisions or subsidiaries. Upon Sponsor's request, Entrants agree to sign any and all legal forms deemed necessary by Sponsor in connection with the above grant of rights.
    9. Representations and Warranties/Indemnification. By entering this Contest, Entrants represent and warrant as follows: (i) their entry is Entrant's own original work and was created solely by Entrant for the purpose of entering the Contest, (ii) the entry, as of the date of submission, is not the subject of any actual or threatened litigation or claim, (iii) the entry has not been previously published, distributed or otherwise exploited, (iv) the entry does not and will not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity, (v) that all people shown in any videos submissions have given their permission to participate in this Contest and to have their likeness/image appear on the Internet (if a person is a minor, permission has been obtained from his/her legal guardian/parent), (vi) does not contain any obscene or pornographic material and does not contain any defamatory statements and (vii) the entry does not and will not violate any applicable laws. Each Entrant hereby agrees to indemnify and hold the Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors harmless from and against any and all claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach by Entrant of any provision of the Official Rules, including, without limitation, any of the warranties, representations or agreements of Entrant hereunder.
    10. No Tampering, Right To Cancel, Modify. Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prize to Entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) Entrants who have committed fraud or deception in entering or participating in the Contest or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor's reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Contest, or with any Website promoting the Contest; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Contest multiple times through the use of multiple e-mail addresses or the use of any robotic or automated devices to submit entries. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Contest, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Contest promotion, including the entire Contest promotion, and/or modify the Contest and/or award the prize based upon the criteria set forth in these Official Rules from all eligible entries received as of the termination date. Sponsor further reserves the right to cancel or suspend part or all of the Contest if any associated social media platform changes its rules or guidelines during the course of the Contest so as to interfere with Sponsor's intended conduct of this Contest. LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE SPONSOR'S CONTEST WEBSITE OR INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
    11. Release of Liability; Disclaimer of Warranty. By participating in the Contest, Entrants and each winner agrees to release and hold harmless Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors (the "Released Parties"), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, which may occur, in whole or in part, directly or indirectly, in connection with preparation for, or participation in, the Contest, or possession, acceptance and/or use or misuse of the prize or participation in any Contest-related or prize-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. The Released Parties assume no responsibility for any injury or damage to Entrants or to any other person's computer, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Contest. Entrants and winner acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to any prize or any component thereof, including, but not limited to, express warranties provided by the supplier of the prize (or any component thereof) or their affiliates. By participating in the Contest, Entrants agree to be bound by the Sponsor's Terms of Use which can be found at http://www.celestialseasonings.com/terms-of-use and Privacy Policy which can be found online at http://www.celestialseasonings.com/privacy-policy. In the event of any inconsistency between the Terms of Use/Privacy Policy and these Official Rules, then these Official Rules shall control. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, each Entrant agrees that, by entering the Contest, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (iii) under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses, whether foreseeable or otherwise. This Contest shall be governed by, and construed in accordance with, the laws of the State of New York, regardless of conflicts of laws principles. Any action or litigation concerning this Contest shall take place exclusively in the federal or state courts sitting in New York County, New York, and each winner expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each winner agrees to service of process by mail or other method acceptable under the laws of the State of New York.
