OFFICIAL RULES   

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR  CHANCES OF WINNING.   

1. ELIGIBILITY: The Capital One® 2014 KaCHING Sweepstakes ("Sweepstakes") is open only to legal residents of the  50 United States and the District of Columbia, who are 18 years of age or older. Employees, directors, officers, and  agents of Capital One N.A. ("Sponsor"), its parent company, divisions, affiliates, subsidiaries, advertising and  promotional agencies, including Ignition Network, and any other company involved in the development, promotion, or  execution of the Sweepstakes, as well as the members of each of the immediate families (spouse, parents, children,  siblings, and in-laws) and persons residing in the same household as such individuals are not eligible to enter or win.  Void where prohibited by law. Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

Limit one (1) entry per person/Twitter account per Sweepstakes Period, provided each entry is unique. Only original  tweets with the hashtag #kaching are entered into the Sweepstakes. Retweets will not qualify for entry into the  Sweepstakes. Duplicate tweets will not qualify for entry into the Sweepstakes. Use of automated methods to enter  are prohibited. Entries that have been generated by a script, macro, bot or any other automated means will be  deemed void. Entrant may not enter using multiple Twitter accounts. If an entrant attempts to enter with multiple  Twitter accounts, under multiple identities, entrant will be disqualified and forfeit any and all prizes won, at the  Sponsor's discretion. Proof of submission of an entry will not be deemed to be proof of receipt by Sponsor. Sponsor  reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process. Entries may  be subject to verification. Entries will be deemed to have been submitted by the authorized Twitter account holder  associated with the username used to tweet the Entry. The authorized Twitter account holder is defined as the  natural person who is assigned to a Twitter username by Twitter.   

Entry must be original and must not be obscene, indecent or contain profanity; must not include any trademarks  owned by anyone other than the Sponsor or the participating colleges and universities; must not include or infringe  any copyrighted materials owned by any third party; must not reference or promote the use of alcohol, illegal drugs,  tobacco, or firearms/weapons; must not include disparaging remarks about Sponsor or its products/services or be  otherwise inconsistent with the Sponsor’s positive image; must not violate the Twitter.com Terms of Service; and  must not identify or reference any person ("Entry Restrictions"). Sponsor reserves the right to waive the Entry  Restrictions set forth herein, or disqualify an Entry, on a case by case basis in its reasonable discretion.   

3. SWEEPSTAKES PRIZES: Six (6) Grand Prizes (one per Sweepstakes Period): $1,500 (each awarded as a check payable to the winner).  

4. GRAND PRIZE DRAWINGS: A random drawing to award one (1) Grand Prize will be conducted for each  Sweepstakes Period from all eligible entries received on or about the dates listed below. Non-winning entries will not  carry over to subsequent Sweepstakes Periods. Drawings will be conducted by Ignition Network, an independent  judging organization, whose decisions are final on all matters relating to the Sweepstakes. Odds of winning depend  upon the number of eligible Entries received for each of the Sweepstakes Periods.   

Sweepstakes Period 1 Drawing: On or about 3/28/14.
Sweepstakes Period 2 Drawing: On or about 3/31/14.
Sweepstakes Period 3 Drawing: On or about 3/31/14.
Sweepstakes Period 4 Drawing: On or about 3/31/14.
Sweepstakes Period 5 Drawing: On or about 4/7/14.
Sweepstakes Period 6 Drawing: On or about 4/8/14.
 

5. WINNER NOTIFICATION/VERIFICATION: Potential winners will be notified by direct Twitter message to the Twitter  username from which the selected Entry was received. Potential winners who are not following @CapitalOne will be  asked to follow in order to receive a direct Twitter message from Capital One. Potential winners will be required to  send their contact information to the email address specified in the notification message within three (3) days of  receiving the notification message or prize will be forfeited in its entirety and may be awarded to an alternate winner.  Potential winners are subject to verification of eligibility and compliance with these Official Rules. Potential winners  will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where requiring a  publicity release is prohibited) and IRS Form W-9 within three (3) days of attempted notification or prize will be  forfeited in its entirety and may be awarded to an alternate winner. Failure to provide all required information and a  signature on the documents will result in forfeiture of winner’s right to claim a prize and may be awarded to an  alternate winner, if time permits. In the event of noncompliance with these Official Rules, or if prize notification or  prize is returned as undeliverable, the prize will be forfeited and may be awarded to an alternate winner. Federal,  state, and local taxes on prize and any expenses relating to the acceptance of and use of prize not specified herein  are the responsibility of winner. Sponsor will issue an IRS Form 1099-MISC for each winner whose prize is valued at  $600 or more. Limit one (1) Grand Prize per person/Twitter Account/household.   

6. ADDITIONAL TERMS: Submission of an Entry grants Sponsor and its agents an unlimited, worldwide, perpetual,  license and right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without  limitation, and without consideration to the entrant, whether or not such submission is selected as a winning Entry.  By accepting a prize, winners consent to the use of their names, likenesses, photograph, statements, voices and/or  biographical information for advertising and promotional purposes without additional compensation, except where  prohibited by law. All winners, by acceptance of prize(s), acknowledge compliance with these Official Rules and  agree to release and hold Sponsor, its affiliates, subsidiaries, and each company’s respective officers, directors,  employees, independent contractors, representatives, and agents ("Releasees") harmless from and against any  claim or cause of action arising out of participation in the Sweepstakes or the receipt, redemption or use of a prize,  including any injuries or damages of any kind sustained in connection with the use, acceptance, possession or  awarding of any prize. By participating in this Sweepstakes, an entrant agrees to be bound by the Official Rules and  by the decisions of the independent judging organization, which are final and binding on all matters. Sponsor  reserves the right to modify prize and award procedures at its discretion.   

7. LIMITATION OF LIABILITY: Sponsor and Releasees are not responsible for printing, typographical, human or other  errors of any kind in any Sweepstakes-related materials or for entries that are lost for any reason, including  electronic, computer, or network error, omission, interruption, defect, delay in operation or transmission, or any  combination thereof. If, for any reason, this Sweepstakes is not capable of running as planned, or infection by  computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any  other causes corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes,  Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes and  award prizes from among all eligible non-suspect entries validly received prior to the action requiring such  modification. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering  with the entry process or the operation of the Sweepstakes; to be acting in violation of the Official Rules; or to be  acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other  person and void any associated prize claims. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY  DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A  VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS  AND ADMINISTRATOR RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE  FULLEST EXTENT OF THE LAW. Sponsor is not responsible for any typographical, technical, or other error in the  administration of the Sweepstakes or in the announcement of prize winners. In no event will more than the number  of prizes stated in these Official Rules be awarded. If, for any reason, more prize notifications are sent (or more claims are received) than the number of prizes offered, as set forth in these Official Rules, Sponsor reserves the  right to award the intended number of prizes through a random drawing from among all eligible prize claims  received. In the event Sponsor is prevented from continuing with the Sweepstakes or the integrity and/or feasibility of  the Sweepstakes is severely undermined by any event beyond the control of Sponsor, including but not limited to  fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or  equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal,  state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus,  unauthorized intervention, technical failures or other cause not reasonably within the control of Sponsor (each a  "Force Majeure" event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify,  suspend, cancel or terminate the Sweepstakes without any further obligation. If Sponsor, in its discretion, elects to  alter this Sweepstakes as a result of a Force Majeure event, a notice will be posted to the Capital One Twitter feed.  In the event of cancellation, Sponsor will award the prizes in a random drawing from among all valid and eligible  entries received up to the time of such cancellation, providing a sufficient number of entries are received. By  participating in this Sweepstakes and submitting an Entry, each entrant agrees: (i) to be bound by these Official  Rules, including all entry requirements; (ii) to release and hold Sponsor, its parent company , affiliates, subsidiaries,  and promotion agencies involved in the administration of the Sweepstakes, and each company’s respective officers,  directors, employees, independent contractors, representatives, and agents ("Release Parties"), harmless against  any and all claims, injuries, damages, losses and liability that may occur, directly or indirectly, in whole or in part,  from the participation in the Sweepstakes or from the receipt or use of any prize; and (iii) that Released Parties have  neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed  or implied, in fact or in law relative to any prize, including but not limited to its quality, mechanical condition or fitness  for a particular purpose. As a condition of participating in this Sweepstakes, each entrant agrees that any and all  disputes, claims and causes of action arising out of or connected with this Sweepstakes or the prizes awarded shall  be governed by the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules, and  that any and all disputes that cannot be resolved between the parties and causes of action arising out of or  connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively  before a court located in Virginia. Further, in such dispute, under no circumstances will entrant be permitted to  obtain awards for and hereby waives all rights to claim punitive; incidental; or consequential damages, including  reasonable attorney’s fees, other than participants actual out of pocket expenses (i.e. costs associated with entering  this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.
